Terms and Conditions

The Terms and Conditions take precedence over any oral or written representations by

Property Energy Assessment.

   1. Property Energy Assessment agree to carry out a Home Inspection on the acquiesce property within 3 working days from the day we receive the request.

   2. After making the booking, the client is deemed to have accepted these Terms and Conditions upon the Home Inspector arriving on site.

   3. The Home Inspection is based on a visual inspection of reasonably accessible parts of the property, taking into account the prevailing structural and weather conditions at the time of the inspection.

   4. Property Energy Assessment does not accept responsibility for services other than those provided in the Home Inspection.

   5. The energy assessment is based on the RDSAP methodology.

   6. The Home Inspection will not disclose defects, pests, mould or asbestos. If however asbestos-based materials are found or suspected, the Home Inspection may have to be postponed until the area is made safe.

   7. Payment by cheque made payable to Prakash Brinicombe or cash to be paid at the time of the Home Inspection. Any credit terms would be agreed individually and confirmed in writing prior to the Home Inspection. Any failure to abide by the credit terms will mean that all payment will become due within 7 days, at this stage a credit collection agency will be authorised if payment is not made.

   8. All Energy Performance Certificates and Home Information Packs remain the property of Property Energy Assessment until full payment has been received.  

   9. If the Home Inspection cannot be completed; due to access restrictions, no appropriate adult present, criminal activity suspected, The occupier appears to be under the influence of alcohol or drugs, or a high risk to the Home Inspector is identified, the full fee will still apply, although an Energy Certificate will not be produced due to incomplete information.

   10. Property Energy Assessment’s liability with respect to the advice given in this report shall be limited to a refund of the Assessment fee.

  11. Complaints procedure;

      (a) If you are dissatisfied with the Home Inspection you must give Property Energy Assessment written notice specifying the matters about which you are dissatisfied before taking any remedial action.

      (b) Within 14 days of giving the notice, you and Property Energy Assessment shall meet to attempt to resolve the matters.

      (c) If at the expiration of 14 days from the giving of the notice any dispute, controversy or claim arising out of the matters shall remain unresolved, the matters shall be the subject of a mediation to be conducted by a mediator appointed by agreement between you and Property Energy Assessment or appointed by the Chairperson of The Institute of Arbitrators & Mediators, with the cost of such mediation shared equally by both parties.

      (d) In the event that the matter has not been resolved within 28 days after the appointment of a mediator, such dispute, controversy or claim may be submitted to litigation.
